These Terms of Service ("Terms") govern your access to and use of the Zahan platform, our AI-powered quiz generation platform ("Confidence Engine"), the "Pre-made Templates" games, and any other software, features, or services we provide (collectively, the "Service").
Please read these Terms carefully. By creating an account or using our Service, you agree to be bound by these Terms and our Privacy Policy.
1. Your Account
Eligibility: You must be of legal age to form a binding contract to use our Service. If you are using the Service on behalf of an organization (our "Customer"), you represent that you have the authority to bind that organization to these Terms.
Account Security: You are responsible for all activity that occurs under your account. You must maintain the security of your account credentials and notify us immediately of any unauthorized use. Accounts are for individual use and may not be shared.
Accurate Information: You agree to provide true and accurate information when you register and to keep it updated.
2. The Zahan Service
Zahan provides a platform that allows you to generate, customize, and host interactive quizzes/games. Our core technology includes our "Confidence Engine," which transforms your text prompts into educational content, and our "Pre-made Templates" games, designed for ease of use and training.
3. Intellectual Property Rights: A Clear and Simple Guide
This is important, so we want to be very transparent about who owns what.
Our Intellectual Property: Groqify owns all rights to the Service itself. This includes our software, the "Confidence Engine," our branding, our website's look and feel, and all our proprietary AI prompts and systems. You may not copy, modify, or reverse-engineer any part of our Service.
Your Content (Your Prompts): You (or your organization) retain full ownership of the original text prompts and any other content you provide to the Service ("User Content"). By using the Service, you grant Groqify a non-exclusive, worldwide, royalty-free license to use your User Content solely to provide and improve the Service for you.
AI-Generated Content (The Quizzes): Our goal is to provide a powerful tool, not to own the content it helps you create. Under current U.S. law, works created solely by an AI system without sufficient human creative input are generally considered to be in the public domain. Therefore, Groqify does not claim any copyright ownership over the quizzes (questions, answers, and explanations) generated by our AI. You are free to use this AI-generated content, but please be aware that it may not be eligible for copyright protection itself.
4. Acceptable Use
We trust you to use our Service responsibly. You agree not to:
- Use the Service for any illegal or unauthorized purpose.
- Submit prompts or content that is hateful, defamatory, harassing, or discriminatory.
- Infringe on the intellectual property rights of others. Do not ask the AI to generate quizzes based on copyrighted material that you do not have the rights to use.
- Use the Service to create or distribute malware, spam, or other malicious content.
- Impersonate another person or entity.
- Attempt to disrupt or overload our systems.
We reserve the right to suspend or terminate accounts that violate these rules.
5. For Organizations (Our Customers)
If you are using Zahan as part of an organization, the organization is our "Customer." The Customer is responsible for the conduct of all its authorized users and for ensuring they comply with these Terms. The Customer owns the User Content (the prompts) submitted by its employees and controls the administration of its accounts.
6. Fees and Payment
In the future - all fees, billing cycles, and payment terms will be specified in a separate Order Form or subscription agreement between Groqify and the Customer. All payments are non-refundable unless required by law.
7. Termination
By You: You can stop using the Service and terminate your account at any time.
By Us: We may suspend or terminate your access to the Service if you materially breach these Terms. We will provide you with reasonable notice where possible. Upon termination, your right to use the Service will cease, and we may delete your account and data according to our data retention policies.
8. Disclaimers and Limitation of Liability
"AS IS" Service: The Service is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the Service will be uninterrupted or error-free.
AI Content Disclaimer: The AI-generated content is provided for informational purposes. While we strive for accuracy, we do not warrant that the AI-generated content is accurate, complete, or reliable. You are responsible for reviewing and validating all content before use.
Limitation of Liability: To the fullest extent permitted by law, Groqify shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of the Service. Our total liability will not exceed the amount you paid us in the 12 months preceding the claim.
9. General Terms
Changes to Terms: We may modify these Terms from time to time. If we make a material change, we will provide you with reasonable notice (e.g., via email or an in-app notification). Your continued use of the Service after the changes take effect constitutes your acceptance of the new Terms.
Governing Law: These Terms shall be governed by the laws of the State of, without regard to its conflict of law provisions.
